1.1 Use of this site constitutes your acceptance to the Skills Platform Terms of Use, which take effect immediately on your first use of the service. Please also see our Privacy Policy and Cookie Policy, which apply as if specifically set out in the Skills Platform Terms of Use. Skills for Health or Skills Platform may be used interchangeably throughout this document.
1.2 SKILLS FOR HEALTH may change these Terms of Use and the Associated Policies or the site content or functionality at any time by posting changes online. You are responsible for reviewing regularly information posted online to obtain timely notice of such changes. Your continued use of this site after changes are posted constitutes your acceptance of this agreement as modified by the posted changes.
2.1 The Skills Platform is an online market place for people to share, promote and possibly purchase relevant opportunities through the creation of profile pages and the promotion of services and products ("Opportunities" or "Opportunity").
2.2 Opportunities are posted by:
2.2.1 organisations offering training (including e-learning) or skills development opportunities, who wish to promote their services through the Skills Platform ("Provider"); or
2.2.2 an individual or organisation who offers skills development opportunities through coaching and mentoring, and/or through advice, research and support ("Consultant"); and
2.2.3 consumed by any individuals or organisations who take advantage of the Opportunities promoted through the Skills Platform ("Customer").
2.3 Opportunities will be provided on the terms and conditions of the Provider or Consultant as applicable, including in respect of the payment for and delivery of services relating to the Opportunity if applicable.
2.4 Whether you are a Provider, Consultant or Customer you acknowledge and agree that SKILLS FOR HEALTH is not responsible for any Opportunities made available on the Skills Platform. Accordingly, you agree and acknowledge that SKILLS FOR HEALTH does not make any representation or endorsement about the Opportunities or give any warranty of any kind, whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility or accuracy regarding the Opportunities.
2.5 Skills for Health via the Skills Platform may serve you with additional emails regarding your registration and training courses that we believe you may hold a legitimate interest in. These are not general marketing emails and only refer to particular courses you may have purchased or were about to purchase.
3.1 Fees:
Skills Platform fees are made up of two parts:
These fees agreed in advance with any provider.
4.1 The Skills Platform operates its online electronic payments through Stripe.
4.2 Payment of fees online is collected by our electronic payment provider Stripe, which is regulated by the Financial Conduct Authority.
4.2.1.Sensitive personal data such as credit or debit card information, 3D secure data and bank account information will not be stored or retained by SKILLS FOR HEALTH or the Skills Platform. All such data will be securely stored within the Stripe environment. By using Stripe's secure e-commerce functionality, we are ensuring that full PCI compliance is in place.
4.2.2 Any Provider or Consultant who wishes to promote Opportunities through the Skills Platform, using the e-commerce functionality for payment needs to create and manage a Stripe account. More information about setting up a Stripe account and Stripe Connect, click here: https://stripe.com/connect
4.2.3 By using Stripe's 'Connect' function together with the Skills Platform's e-commerce functionality, payment for your services will be transmitted direct from the Customer to your Stripe account less any fees.
4.2.4 If the Skills Platform change the payment processor, we will endeavour to give you notice.
4.3 The Provider [or Consultant] may choose to offer an invoice payment system alongside the Stripe facility. If a Customer purchases from the Skills Platform and chooses to be invoiced, the Skills Platform will immediately email the Provider with details of the booking. The Provider [or Consultant] will then be responsible for invoicing the Customer directly and for ensuring receipt of any payments in accordance with the Provider’s payment terms. At the time a purchase is made in accordance with this clause
4.3 If the client pays via invoice, SKILLS FOR HEALTH will invoice the Provider [ or Consultant ] for the Commission due when the value of this commission owed is greater than £25. The Commission shall be paid by the Provider [or Consultant] within 40 days of the date of our invoice. Card payment commission is taken at the point of sale.
4.4 SKILLS FOR HEALTH will not participate in any dispute between Providers or Consultants and Customer relating to the provision of the Opportunity.
4.5 In the event that a Provider or Consultant refunds all or any part of the cost of an Opportunity to the Customer who paid via invoice, SKILLS FOR HEALTH will not refund the Commission. In certain circumstances, at the discretion of SKILLS FOR HEALTH, consideration may be given to refunding the Commission. Providers can refund/ cancel customers from within their own dashboard.
4.6 By posting Opportunities on the Skills Platform Providers or Consultants accept and agree that the terms stated are at least as favourable as those granted by the Provider or Consultant on their own site or any other site or platform which they use to advertise Opportunities.
5.1 SKILLS FOR HEALTH may terminate, suspend or withdraw access to the Skills Platform at its sole discretion.
5.2 It is in Provider's best interests to respond to any enquiries as quickly as possible. Repeated failure to respond to enquiries within 5 working days may result in termination of listing.
6.1 Consultants or Providers who wish to cancel their registration should send an email requesting cancellation to support@skillsplatform.org.
6.2 SKILLS FOR HEALTH will endeavour to remove the Consultant or Providers details from the Skills Platform within 10 business days of receipt of the request.
